By signing up for and using services provided by Cable Instant ("we," "us," or "our"), you agree to comply with and be bound by these Terms & Conditions. These terms govern your use of our internet, cable TV, and related equipment and services. If you do not agree with any part of these terms, please do not use our services.
2. Service Availability and Speeds
Services are subject to availability at your specific service address. Not all services or speeds are available in all areas. Advertised internet speeds (such as "Up to 500 Mbps") represent maximum wired connection speeds to your home. Actual speeds may be lower due to network congestion, the condition of your home wiring, wireless interference, the capabilities of your devices, and other factors outside our control. We provide a best-effort service.
3. Acceptable Use Policy
You agree to use our network and services only for lawful purposes. Prohibited activities include but are not limited to:
- Distributing malware, viruses, ransomware, or unsolicited bulk email (spam).
- Engaging in any unlawful activity, including copyright infringement through unauthorized distribution of copyrighted content.
- Operating commercial servers, hosting services, or running high-volume business traffic on a residential plan without written approval.
- Reselling, redistributing, or sharing our service to other residences or commercial premises.
- Attempting to gain unauthorized access to other networks, systems, or accounts (hacking).
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your service without refund. We reserve the right to cooperate with law enforcement and affected parties in investigating violations.
4. Billing and Payments
Services are billed monthly in advance on your billing cycle date. Payment is due upon receipt of your invoice or auto-charge date. Failure to pay within 10 days of the due date may result in service interruption. A late fee may be applied to overdue accounts. We take pride in transparent pricing; your monthly rate will not be increased without at least 30 days prior written notice.
5. Company Equipment
Modems, routers, set-top boxes, and any other equipment provided by Cable Instant remain the property of Cable Instant unless you have explicitly purchased the equipment. You are responsible for the reasonable care of leased equipment. You must return all leased equipment in working condition within 14 days of service cancellation to avoid unreturned equipment charges. Equipment damaged beyond normal wear and tear may be subject to replacement fees.
6. Service Interruptions
We strive to maintain 99.9% uptime, but service interruptions can occur due to scheduled maintenance, equipment failures, weather events, or other circumstances beyond our control. We will make reasonable efforts to notify customers of planned maintenance in advance. We are not liable for damages arising from service outages outside our control.
7. Limitation of Liability
Cable Instant's liability to you for any claim arising from or related to these terms or our services shall not exceed the total amount you paid for the service during the three months prior to the claim. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of our services.
8. Modifications to Terms
We reserve the right to update these Terms & Conditions. Material changes will be communicated via email or posted notice at least 30 days before they take effect. Continued use of our services after the effective date constitutes acceptance of the updated terms.
9. Governing Law
These terms shall be governed by the laws of the State of New York. Any disputes shall be resolved in the courts of New York County, New York.
